Homexpert Home Inspection Agreement

1. Parties

This Pre-Inspection Agreement (“Agreement”) is entered into by and between:

3. Inspection Fee and Payment

The inspection fee is: , subject to Homexpert confirmation.

Unless otherwise agreed in writing, payment is due on the day of the inspection. Payment may be collected at the inspection or by another method confirmed by Homexpert LLC.

4. Required New York Written Contract Notice

The following notices are included pursuant to New York home inspection written contract requirements:

“Home inspectors are licensed by the NYS Department of State. Home Inspectors may only report on readily accessible and observed conditions as outlined in this pre-inspection agreement, Article 12-B of the Real Property Law and the regulations promulgated thereunder including, but not limited to, the Code of Ethics and Regulations and the Standards of Practice as provided in Title 19 NYCRR Subparts 197-4 and 197-5 et seq. Home inspectors are not permitted to provide engineering or architectural services.”

“If immediate threats to health or safety are observed during the course of the inspection, the client hereby consents to allow the home inspector to disclose such immediate threats to health or safety to the property owner and/or occupants of the property.”

5. Scope of Inspection

The inspection is a limited, non-invasive, visual inspection of the readily accessible and observed systems and components of the residential property as they exist at the time of inspection.

The inspection may include readily accessible visible portions of:

  • Roof, exterior, grading/drainage, and attached structures
  • Structural components
  • Basement and/or crawl space, where accessible
  • Attic, insulation, and ventilation, where accessible
  • Electrical system
  • Plumbing system
  • Heating and cooling systems
  • Interior rooms, walls, ceilings, floors, windows, doors, stairs, railings
  • Kitchen and bathroom visible components
  • Garage and visible safety-related items

The scope of the inspection will be discussed with the Client, and Homexpert LLC will perform only services authorized by the Client.

6. Report

The Client will receive a written inspection report describing observed visible conditions, including items that in the Inspector’s opinion may be deficient, unsafe, not functioning as intended, or in need of repair, monitoring, or further evaluation.

The report is based only on conditions visible and accessible at the time of inspection. Conditions may change after the inspection.

7. Not a Warranty, Guarantee, Code Inspection, or Insurance Policy

The inspection and report are not:

  • A warranty or guarantee of the property condition
  • A guarantee that all defects will be discovered
  • A code compliance inspection
  • An engineering or architectural evaluation
  • An appraisal or valuation
  • A prediction of future performance or remaining useful life
  • An insurance policy

8. Limitations and Exclusions

The Inspector is not required to:

  • Move furniture, stored items, rugs, insulation, snow, debris, personal property, or appliances
  • Open walls, ceilings, floors, or concealed areas
  • Dismantle systems or components
  • Enter unsafe or inaccessible areas
  • Operate systems that are shut down, unsafe, inaccessible, or may be damaged by operation
  • Determine property boundaries, easements, zoning, permits, or legal use
  • Determine presence or absence of hazardous materials unless separately contracted
  • Determine concealed mold, asbestos, lead, radon, environmental hazards, underground tanks, pests, or wood-destroying insects unless separately agreed in writing
  • Inspect detached structures, pools/spas, wells, septic systems, security systems, low-voltage systems, smart-home systems, or specialty equipment unless separately agreed in writing

9. Optional Additional Service

The only optional additional service currently offered through this agreement is:

  • ☐ Termite / wood-destroying insect inspection or related support

Other specialty services, including but not limited to radon testing, mold assessment/testing, sewer scope, pool/spa inspection, engineering, architectural, or environmental testing, are not included unless separately arranged with an appropriately qualified professional.

10. Appliances

Appliances are not part of the core home inspection unless specifically agreed. If appliances are observed or operated, it is a basic courtesy check only and does not determine full performance, cycle completion, temperature calibration, hidden defects, recalls, or remaining service life.

11. Client Attendance

Client attendance is recommended when possible. Attendance helps the Client understand observed conditions and ask questions. If the Client cannot attend, the written report will serve as the primary communication of findings.

12. Report Use and Confidentiality

The report is prepared for the sole and exclusive use of the Client named in this Agreement. No third party may rely on the report without Homexpert LLC’s written permission.

The Client may share the report with their real estate agent, attorney, lender, or other transaction professionals for the Client’s transaction purposes. Sharing the report does not create a contractual relationship between Homexpert LLC and any third party.

13. Photographs and Client Portal

Homexpert LLC may include photographs in the report to document observed conditions. If a client portal or secure report link is used, the Client is responsible for keeping the link private. Homexpert LLC will make reasonable efforts to keep report access private and not publicly indexed.

14. Notice of Claim and Right to Reinspect

If the Client believes the Inspector failed to report a condition that should have been reported, the Client agrees to notify Homexpert LLC in writing before making repairs, altering the condition, or disposing of evidence, except in an emergency.

The Client agrees to allow Homexpert LLC a reasonable opportunity to reinspect the condition before repairs are made when practical.

15. Entire Agreement

This Agreement represents the entire agreement between the Client and Homexpert LLC regarding the inspection. Any changes must be in writing and accepted by both parties.

16. Electronic Signature

By typing their full name and submitting the inspection request, the Client agrees that the typed name is their electronic signature for this Agreement.
